CONSTITUTION AND BY-LAWS OF THE
UNLAD PILIPINAS PARTY
P R E A M B L E
We, the Global Filipinos, as citizens of the Republic of the Philippines, guided by our strong faith to the Almighty God, love of country, respect of the dignity of man, and by the principles of sovereignty, democracy, human rights, justice, equality, morality, ethics, and healthful ecology,
Aspiring to end the reign of traditional politics of patronage, elitism, discrimination, exploitation, and warlordism,
Believed and committed to practice, promote, and pursue a progressive politics of principles, programs, people empowerment and subsidiarity,
Pulled together by duty—which we hold sacrosanct—to take action to restore these ideals and principles in public office through a political party, by itself or in cooperation with other organizations or groups with similar position,
Do hereby ordain and promulgate this Constitution and By-laws.
ARTICLE I. NAME, COLORS, SYMBOL and HEADQUARTERS
Section 1. Name. This political party shall be called UNLAD PILIPINAS PARTY; hereinafter referred to as UNLAD PILIPINAS , or “the Party”. The short name of the Party is UNLAD.
SECTION 2. Colors. The Colors of the Party shall be Blue, Red, Yellow and White.
SECTION 3. Symbols. The official logo, anthem, slogan, creed, and other symbols of the Party which must be truly reflective and symbolic of Party objectives, principles and programs shall be approved by the National Executive Council.
SECTION 4. Headquarters. The Party shall establish and maintain National Headquarters in the National Capital Region. It may establish Regional Headquarters in Luzon, Visayas, Minadanao, North America, Europe, Middle East, and in key cities in Asia.
ARTICLE II: DECLARATION OF PRINCIPLES AND OBJECTIVES
SECTION 1. Vision and Mission of the Party.
(a) Vision. The Party envisions a nation committed to the sustained reform and renewal of its people and governance, for the progress and welfare of the Global Filipino Nation; to carrying out the Unfinished Revolution of 1896 initiated by our great heroes; and to contributing to global peace and development.
(b) Mission. The Party shall pursue and promote the development of good citizens and leaders and appropriate institutions, policies and governance that will enable us to achieve our desired Freedom, Democracy, Peace, Equality, Justice, Prosperity, Environment, and Solidarity under a Loving God united in forging and enforcing the needed constitutional, political, economic, social, cultural, moral, ethical and spiritual reforms.
Section 1. Principles. The Party adheres to the following guiding principles for the restructuring, maintenance, and development of the political, economic, and socio-cultural systems of Philippine society:
(1) People Empowerment which underscores that human development is attainable for all through the people’s active participation in and command of every aspect of human life.
(2) Sustainable Development which asserts that a bountiful natural habitat and environment for all generations to enjoy is achievable through the application of labor, capital, enterprise, and technology that would preserve the habitat and promote a safe, productive environment.
(3) Social Justice which, affirming that the Almighty’s work is for the good of all and that man is created as the steward for the common good, avows that a humanistic society is attainable through man’s continuous striving for the creation and equitable distribution of wealth.
(4) Subsidiarity which recognizes the people’s right to and capability for self-determination and self-fulfillment; emphasizes self-help, participation, decentralization, deregulation and autonomy.
(5) Solidarity which stresses that the common good and the national interest are paramount at all times across and above individual, sectoral, or parochial interests.
Section 2. Faith in God. The Party ensures the free exercise of faith in the Almighty God and believes that human beings were created and vested by Him with freedom and dignity. The Party, therefore, upholds the value of human life from inception and the inherent dignity and worth of man. It guarantees full respect for the exercise of his civil, social, economic, and political rights under a just and dynamic social order.
Section 4. Family. The Party affirms the family as the most important basic social unit which must be upheld, respected, and protected at all times.
Section 5. Nationalism and Patriotism. The Party primarily promotes the national interest and patriotism, and encourages participation in governmental and civic affairs.
Section 6. Sustainability. The Party pursues a policy of expanded productivity that will ensure measures that conserve the national patrimony and maintain ecological balance.
Section 7. Social Economy. The Party, recognizing the role of the State in protecting its citizens, acknowledges its authority to intervene, in instances when market forces are obstructed or become harmful to the people, and to restore their free operation under a socially oriented market economy.
Section 8. Self- Determination. The Party, underscoring the right to self-determination, pursues a policy that secures the Filipino citizens’ exercise and effective control over natural resources for their individual benefit and the common good.
Section 9. Poverty Alleviation. The Party shall pursue a policy that adopts and promotes humane, viable and effective solutions to poverty, unemployment and underemployment, and inefficient service delivery.
ARTICLE III: MEMBERSHIP
Section 1. Qualifications. Any Filipino citizen of age Fifteen (15) and above at the time of application who accepts the Principles, Program and Constitution of the Party and willing to follow fundamental Party decisions and submit himself/herself to the Party discipline may apply for regular membership in the party.
Section 2. Disqualifications. No applicant shall be accepted for Party membership if he or she is:
(1) a member of any political party or any other organization whose ideology, objectives, policies, and programs are contrary to or inconsistent with the Constitution and by-laws of the Party;
(2) commission of any act contrary to the ideology, objectives, policies and programs of the Party; and,
(3) finally convicted of a crime involving moral turpitude.
Section 3. Recommendation. Every applicant shall be recommended by two bona fide members and shall undergo screening by a third bona fide member authorized accordingly.
Section 4. Seminar. An applicant shall complete a seminar on the Program and Constitution and by-laws of the Party conducted by a duly accredited party organ in order to become a member.
Section 5. Acceptance. Application for membership shall be decided upon by the executive committee of the Barangay Council subject to review by a meeting of the chapter or by the next higher leading body of the party.
Section 7. Oath of Membership. Following is the oath that every member takes upon admission into the Party, administered by any duly authorized Party Officer:
"I, _____________________, having been accepted as a member of the UNLAD PILIPINAS Party, do hereby solemnly swear that I will uphold and advance the principles, objectives and program of the Party, abide by its Constitution and by-laws, raise its prestige and widen its influence among the people, and that I will fight for the interests of our country and people and serve them wholeheartedly and unselfishly."
Section 8. Termination. Membership in the party may be terminated through voluntary resignation or by expulsion on just and valid grounds by the appropriate organ of the party after proper hearing and due process.
ARTICLE IV: DUES AND ASSESSMENTS
Section 1. Membership Fee. All applicants to the party coming from the working masses or who are impoverished shall pay a one-time membership fee of five (5) pesos minimum. Those coming from the better off sections shall pay a one-time membership fee of ten (10) pesos minimum.
Section 2. Annual Dues. All members of the party coming from the working masses or who are impoverished shall pay an annual membership due of five (5) pesos minimum. Those coming from the better off sections shall pay an annual membership due of ten (10) pesos minimum.
Section 3. Special Assessment. Members of the party may be charged with special assessments by the leading bodies of the party on the basis of specific projects or requirements.
Section 4. Contributions. All members are encouraged to provide additional contributions based on their individual capacity.
ARTICLE V: RIGHTS AND DUTIES OF MEMBERS
Section 1. Rights and privileges. A Party Member shall have the following rights and privileges:
(1) participate in official activities and functions of the Party;
(2) be fully informed on official Party matters;
(3) access to services, facilities, and other Party resources;
(4) a membership identification card and certificate, and such other documents which attest to bona fide Party membership;
(5) representation in and protection by the Party for just cause, particularly when his civil, political and socio-economic rights are violated;
(6) vote and be voted for in appropriate Party organizations and positions;
(7) submit proposals to any appropriate body of the party; and,
(8) initiate or petition the imposition of disciplinary measures on erring Party officers and members.
Section 2. Implementation. The National Assembly shall formulate and issue the appropriate implementing policy, administrative and operation all guidelines and procedures for the exercise of these rights.
Section 3. Duties and Obligations of Members. A Party Member in good standing shall:
(1) conduct himself, at all times, in accordance with ethical standards of personal behavior in government, business, the professions, livelihood activities, and community service;
(2) pay his dues and assessments as prescribed by Article IV of this Constitution;
(3) actively promote Party ideals and programs;
(4) regularly attend official Party activities and functions;
(5) actively support and campaign for the official candidates of the Party;
(6) help recruit qualified Party members;
(7) assist fellow members who are in need;
(8) safeguard the Party’s confidentiality;
(9) register as a voter;
(10) report any information that may affect the interest of the Party; and,
(11) abide by the Constitution and By-Laws, and final decisions of the Party.
(12) observe organizational discipline.
ARTICLE VI: PARTY DISCIPLINE
Section 1. Violations. Any member or officer of the Party who commits serious violations of the Program, Constitution and By-Laws and legitimate policies and decisions of the party at any level shall be subject to disciplinary action.
Section 3. Penalties and Gounds. Disciplinary actions shall be meted out based on the gravity of the violation of the party discipline and these shall include the following: censure, demotion, suspension and expulsion from the party from the following grounds:
• Engaging in any act antagonistic to its objectives or inimical to its interest, or for violation of or deliberate failure to support any of its fundamental decisions;
• Malversation of Party funds;
• Failure to attend three (3) consecutive Party meetings or at least 2/3 of the meetings duly convened within a given calendar year of the appropriate committee or organ without valid reason duly communicated within a reasonable period prior to the meeting and subsequently approved by the appropriate committee;
• Misrepresentation of the Party;
• Abuse of authority;
• Non-participation and involvement in Party-sanctioned activities without valid reason duly communicated within a reasonable period prior to the activity and approved by the appropriate committee, and;
• Membership in another political party, either by act or deed.
Section 4. Suspension. Suspension from the Party may be meted to a member or officer of the party for a period not exceeding one year.
Section 5. Expulsion. Expulsion from the Party may be meted to a member or officer of the party for willful violations of the Constitution and for acts inimical to the interest of the party.
Section 6. Recall or Removal The Party shall also work for the recall or removal from public office of party members and officers who have been found to have committed acts inimical to the interest of the country and the people.
Section 7. Observance of Due Process. In meting out disciplinary action, due process shall be upheld:
• Any member of the Party with a complaint against a body of leadership, officer or another member of the party may do so before the chapter he belongs to or at the next higher level. Complaints of a serious nature may be brought directly to the national bodies of leadership.
• A fact-finding committee shall be formed by the body where the complaint has been lodged or by an appropriate body assigned to investigate the complaint.
• The report of the fact-finding committee shall be submitted to the body that formed it for appropriate action. In case of expulsion, this must be based on two-thirds of the votes of the members of the appropriate body.
• In case of expulsion, the decision shall be reviewed by the next higher level of leadership.
• Any disciplinary action against an officer of the party shall be decided upon by the corresponding body that elected him/her to the position.
• Decisions on complaints and disciplinary actions may be appealed for review by the next higher body of leadership up to the National Assembly.
ARTICLE VII: THE PARTY STRUCTURE
Section 1. Organizational Structure. The Party’s organizational structure shall consist of the following:
• The Barangay Council which is the basic unit of the party to be organized at the barangay or barrio level.
• The Municipal and City Councils which shall consist of Barangay Councils.
• The Provincial Councils which shall consist of Municipal and City Councils in component cities; and the City Councils in highly-urbanized cities.
• The Regional Councils of Luzon, Visayas, Mindanao and National Capital Region, which shall consist of the provincial and city councils in highly urbanized cities; and of the American, European and Asian Councils as may be created which shall be composed of the different councils that may be organized in different States or cities therein.
• The National Executive Council.
• The National Assembly.
Section 2. Regional Coordinators There shall be Regional Coordinators to be elected/appointed by the National Directorate from among the Provincial or City Chairpersons who are elected/appointed by the Provincial or City Chapters; and from among the elected/appointed Chairpersons of the American, European and Asian chapters.
ARTICLE VIII: THE NATIONAL ASSEMBLY
Section 1. National Assembly. The National Assembly shall be the highest governing body of the Party. It shall be convened every three (3) years or as decided upon by the National Executive Council.
Section 2. Powers and Functions. The powers and functions of the National Assembly include the following:
• To ratify and amend the Program and Constitution of the party.
• To receive reports and recommendations from the National Executive Council.
• To determine the size and composition and to elect the executive officers of the party and other members of the National Executive Council.
• To decide on candidates for national elective position to be fielded by the party as well as other candidates who may be supported by the party.
• To decide on any matter within its over-all jurisdiction.
Section 3. Composition. The National Assembly shall be composed of:
• Representatives of Provincial, City and Municipal Chapters; and of American, European and Asian Chapters, of the party.
• National officers of the party.
• Personages who have significantly helped further the cause of the party but may not be officers of the party.
Section 4. Size of Delegation. The size and distribution of delegates to the National Assembly shall be decided upon by the National Executive Council.
• ARTICLE IX: THE NATIONAL EXECUTIVE COUNCIL
Section 1. National Executive Council. Between the holdings of National Assembly, the National Executive Council shall be the highest governing body of the party.
Section 2. Composition. The National Executive Council shall consist of the Chairperson, President, Vice-Chairperson, Executive Vice-President, Vice-Presidents for Luzon, Visayas, Mindanao, the National Capital Region, North America, Europe and Asia, the Secretary-General, the Senior Deputy Secretary-General, the Treasurer, the National Auditor, the General Counsel and such other members of the National Council as may be designated by the latter.
Section 2. Powers and Functions. The National Executive Council shall have the authority to conduct and administer the affairs of the party between the meetings of the National Assembly subject to the review and confirmation by the National Assembly. The powers and functions of the National Executive Committee are the following:
• To decide on any matter within its jurisdiction and issue directives.
• To issue statements in the name of the party.
• To appoint a national auditor and general counsel for the party as well as other officers as the need may arise.
• To designate temporary officers in the National Executive Committee to replace vacant positions until the National Assembly elects a permanent replacement.
• To determine the size and distribution of delegates to the National Assembly.
• To submit reports and recommendation to the National Assembly.
• To create and supervise, through the Secretary-General, the General Secretariat.
• To create and supervise other committees necessary to carry out the work of the party.
Section 4. Functions of the National Officers. (a) The Chairperson shall:
(1) Call and preside over the National Assembly
(2) Issue directives and statements on behalf of the National Assembly.
(3) Make representation on behalf of the party and the National Assembly.
(b) The Vice-Chairperson shall:
(1) Take over the functions of the Chairperson in the latter’s absence or incapacity.
(2) Perform such other tasks which may be assigned by the National Executive Committee and the Chairperson.
(c) The Party President shall:
(1) Serve as the Chief Executive Officer of the Party.
(2) Presides over the meetings of the National Executive Council, and issue directives and statements on behalf of the latter.
(3) Represent the party and the National Executive Committee.
(4) Also act as the chief campaign officer of the party.
(d) The Executive Vice-President shall:
(1) Take over the functions of the President in the latter’s absence or incapacity.
(2) Act as the deputy chief campaign officer of the party.
(e) The Vice-Presidents for Luzon, Visayas, Mindanao, National Capital Region, North America, Europe and Asia shall:
(1) Supervise the regional coordinators of the party in their respective jurisdictions.
(2) Act as the chief campaign officer in their respective jurisdictions.
(f) The Secretary-General shall:
(1) Serve as the Chief Operating Officer of the Party
(2) Form and head the General Secretariat which runs the day-to-day functions of the Party.
(3) Sign documents for the Party.
(4) Implement the Party program.
(5) Execute policies and enforce Party discipline.
(6) Keep the records of Membership, the records of the National Assembly and the National Executive Council.
(7) Recommend such deputies and personnel as may be necessary subject to the approval of the National Executive Council.
(f) The Senior Deputy Secretary-General and other Deputies shall:
(1) Assist the Secretary General in discharging his/her functions.
(2) Perform such other functions as may be assigned by the Secretary-General, the National Executive Council.
(g) The National Treasurer shall:
(1) Plan the budget of the party for approval by the National Executive Council.
(2) Act as the over-all manager of the funds and resources of the party.
(h) The National Auditor shall:
(1) Check and audit all resources and funds of the party.
(2) Form auditing teams to investigate any reported financial anomalies.
(i) The General Counsel shall:
(1) Act as the legal counsel of the national bodies of the party.
(2) Make representation on behalf of the party in regard to all legal matters.
ARTICLE X: INTERMEDIATE LEADING BODIES
Section 1. The Municipal/City Council shall be composed of the following:
• Chairpersons and vice-chairpersons of all Barangay Council.
• Representatives of organized sectors existing in the municipality/city and other groups with special social concerns which support the Party.
• Municipal/city executive officers of the Party.
Section 2. The Provincial Council shall be composed of the following:
• Chairpersons, vice-chairpersons, secretary and treasurer of all Municipal and City Councils.
• Representatives of organized sectors existing in the province and other groups with special social concerns which support the Party.
• Provincial executive officers of the Party.
Section 3. The American, European and Asian chapter councils shall be composed of the chairpersons, vice-chairpersons, secretary and treasurer and such sectoral representatives as may be appropriate in each chapter or council.
Section 4. The executive officers shall include the chairperson, vice-chairperson, secretary and treasurer.
ARTICLE XI: THE BARANGAY COUNCIL
Section 1. The basic unit of the Party is the Barangay Council. Every member shall belong to a Barangay Council.
Section 2. A Barangay Council shall have a minimum of ten (10) members.
Section 3. The powers and functions of the Barangay Council shall include the following:
• To implement the programs, policies and decisions of the party.
• To ensure the involvement of members through education, campaigns and other activities.
• To conduct studies on the principles and program of the party and current issues and to subscribe to party publications.
• To recruit members and see to it that they fulfill the requirements for membership.
• To submit reports and recommendations to the Municipal/City Council.
• To elect officers of the Barangay Council.
• To create organizational structures or machinery appropriate to the size of the Barangay Chapter.
Section 4. The Barangay Council shall have an executive committee of at least five (5) members which shall include the chairperson, vice-chairperson, secretary and treasurer.
Section 5. The chairperson shall be the presiding officer of the Barangay Council.
Section 6. The vice-chairperson shall assist the chairperson in the day-to-day performance of his duties; act as chairperson in case of the latter’s absence or temporary incapacity; and succeed as chairperson for the unexpired portion of the term in case of vacancy therein.
Section 7. The secretary shall take the minutes of all the meetings of the assembly and shall be the custodian of all its records.
Section 8. The treasurer shall be the custodian of the funds and other properties of the chapter and co-signatory of the chairperson relative to the disbursement of funds.
Section 9. The officers of the Barangay Council and other members of the executive committee shall be elected by a meeting of the members of the chapter.
ARTICLE XII: FUNDS AND RESOURCES
Section 1. Basic Funds. The basic funds of the Party shall come from membership fees and dues and other special assessments.
Section 2. Fund-Raising. Fund-raising activities shall be launched, as may be prescribed by the National Executive Council.
Section 3. Contributions. Contributions in cash and in kind shall be accepted provided there are no conditions contrary to the principles of the party and to existing laws.
ARTICLE XIII: MISCELLANEOUS PROVISIONS
Section 1. Provisional Bodies. Where regular organs of the party do not yet exist, provisional bodies of leadership may be formed until the requirements of this Constitution can be applied.
Section 4. Regional Groups. The Party shall allow its members to form themselves into regional groups affiliated with the Party, especially in the regions where autonomy is being promoted, with due recognition to the specific features of these regions, using a different name or slightly different name, provided that their program and constitution adhere to the essential parts of the Constitution and By-Laws of the Party.
Section 5. Coalition. The Party may establish or enter into coalition or alliances with other parties, organizations or individual candidates in the national or local levels in line with its principles and program for electoral campaigns and long-term plans for the purpose of achieving common goals.
ARTICLE XIV: AMENDMENTS/REVISIONS
Section 1. Proposal. Any member or body of the Party may propose amendments or revisions to this Constitution but these shall be subject to adoption by the National Executive Committee which shall endorse these to the National Assembly.
Section 2. Approval. Amendments or revisions to this Constitution and By-Laws may be made and effected with the concurrence of three-fourths (¾) plus one (+1) vote of all delegates to the National Assembly.
Section 3. Limitation. No amendment or revision shall be authorized within six (6) years following ratification of this Constitution and By-Laws or more often than once every three (3) years thereafter.
